Section 1 Information on the collection of personal data

(1) Below we provide information on the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g., name, address, email addresses, user behavior.

(3) When you contact us by email or via a contact form, the data you provide (your email address and, if applicable, your name and telephone number) will be stored by us in order to answer your questions. We delete the data arising in this context after storage is no longer necessary, or restrict processing if statutory retention obligations exist.

(4) If we use commissioned service providers for individual functions of our offering or wish to use your data for advertising purposes, we will inform you in detail below about the respective processes. In doing so, we will also specify the defined criteria for the storage period.

Section 2 Your rights

(1) You have the following rights vis-à-vis us with regard to your personal data:

–   right of access,
–   right to rectification or erasure,
–   right to restriction of processing,
–   right to object to processing,
–   right to data portability.

(2) You also have the right to lodge a complaint with a data protection supervisory authority about our processing of your personal data.

Section 3 Collection of personal data when visiting our website

(1) When using the website purely for informational purposes, i.e., if you do not register or otherwise transmit information to us, we collect only the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6(1) sentence 1 lit. f GDPR):

–   IP address
–   date and time of the request
–   time zone difference to Greenwich Mean Time (GMT)
–   content of the request (specific page)
–   access status/HTTP status code
–   amount of data transferred in each case
–   website from which the request originates
–   browser
–   operating system and its interface
–   language and version of the browser software.

(2) In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and assigned to the browser you use, and through which certain information flows to the entity that sets the cookie (here, by us). Cookies cannot execute programs or transmit viruses to your computer. They serve to make the internet offering more user-friendly and effective overall.

(3) Use of cookies:

a)  This website uses the following types of cookies, the scope and function of which are explained below:

–   transient cookies (see b)
–   persistent cookies (see c).

b)  Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. They store a so-called session ID, with which various requests from your browser can be assigned to the shared session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

c)  Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time in your browser’s security settings.

d)  You can configure your browser settings according to your preferences and, for example, refuse the acceptance of third-party cookies or all cookies. Please note that you may not be able to use all functions of this website.

e)  We use cookies to identify you for subsequent visits if you have an account with us. Otherwise, you would have to log in again for each visit.

f)  The Flash cookies used are not captured by your browser but by your Flash plug-in. We also use HTML5 storage objects that are stored on your device. These objects store the necessary data independently of your browser and do not have an automatic expiration date. If you do not want Flash cookies to be processed, you must install an appropriate add-on, e.g., “Better Privacy” for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe Flash Killer Cookie for Google Chrome. You can prevent the use of HTML5 storage objects by using private mode in your browser. We also recommend regularly deleting your cookies and browser history manually.

Section 4 Additional functions and services on our website

(1) In addition to using our website purely for informational purposes, we offer various services that you can use if you are interested. For this, you generally have to provide additional personal data that we use to provide the respective service and for which the data processing principles mentioned above apply.

(2) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.

(3) Furthermore, we may pass on your personal data to third parties if participation in promotions, contract conclusions, or similar services are offered by us jointly with partners. Further information on this is provided when you submit your personal data or below in the description of the respective offer.

(4) Insofar as our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you about the consequences of this circumstance in the description of the offer.

Section 5 Objection to or withdrawal of consent to the processing of your data

(1) If you have given consent to the processing of your data, you can withdraw it at any time. Such a withdrawal affects the permissibility of processing your personal data after you have declared the withdrawal to us.

(2) Insofar as we base the processing of your personal data on a balancing of interests, you may object to the processing. This is the case if the processing is not necessary in particular for the performance of a contract with you, which is explained by us in each case in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as carried out by us. In the event of your justified objection, we will examine the situation and will either stop or adapt the data processing or point out to you our compelling legitimate grounds on the basis of which we will continue the processing.

Section 6 Data protection provisions regarding the use of Xing

The controller has integrated components of Xing on this website. Xing is an internet-based social network that enables users to connect with existing business contacts as well as to establish new business contacts. Individual users can create a personal profile on Xing. Companies can, for example, create company profiles or publish job postings on Xing.

The operating company of Xing is XING SE, Dammtorstraße 30, 20354 Hamburg, Germany.

Each time one of the individual pages of this website is accessed, which is operated by the controller and on which a Xing component (Xing plug-in) has been integrated, the internet browser on the information technology system of the data subject is automatically prompted by the respective Xing component to download a display of the corresponding Xing component from Xing. Further information on the Xing plug-ins can be accessed at https://dev.xing.com/plugins. Within the scope of this technical procedure, Xing obtains knowledge of which specific subpage of our website is visited by the data subject.

If the data subject is logged into Xing at the same time, Xing recognizes with each access to our website by the data subject and during the entire duration of the respective stay on our website which specific subpage of our website the data subject visits. This information is collected by the Xing component and assigned by Xing to the respective Xing account of the data subject. If the data subject clicks one of the Xing buttons integrated on our website, for example the “Share” button, Xing assigns this information to the personal Xing user account of the data subject and stores this personal data.

Xing always receives information via the Xing component that the data subject has visited our website if the data subject is logged into Xing at the time our website is accessed; this occurs regardless of whether the data subject clicks the Xing component or not. If such transmission of this information to Xing is not desired by the data subject, the data subject can prevent the transmission by logging out of their Xing account before accessing our website.

The data protection provisions published by Xing, which can be accessed at https://www.xing.com/privacy, provide information on the collection, processing, and use of personal data by Xing. Furthermore, Xing has published data protection notices for the XING Share button at https://www.xing.com/app/share?op=data_protection.

Section 7 Data protection provisions regarding the use of Google Maps

The controller uses the Google Maps map service to embed an interactive map on some of its web pages.

The operating company of Google Maps is Google Inc., 1600 Amphitheatre Parkway, Mountain View, California 94043, USA. 

When using the services provided by Google Maps via JavaScript, Google Maps transmits personal data such as the IP address of the data subject. The transmission takes place when the data subject has enabled JavaScript in their browser. In addition, Google Maps uses cookies that may provide further information about the websites visited by the data subject. The latter can be prevented by an appropriate setting in the data subject’s internet browser. A JavaScript blocker can also prevent the processing of personal data by Google Maps; however, the functionality of these interactive maps will then also be lost.

Section 8 Registration on our website

The data subject has the option to register on the website of the controller by providing personal data. Which personal data is transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for the transfer to one or more processors, for example a parcel service provider, which also uses the personal data exclusively for internal use attributable to the controller.

By registering on the controller’s website, the IP address assigned by the internet service provider (ISP) to the data subject, the date, and the time of registration are also stored. The storage of this data takes place against the background that this is the only way to prevent misuse of our services and, if necessary, enables committed criminal offenses to be clarified. In this respect, the storage of this data is necessary to protect the controller. This data is generally not passed on to third parties unless there is a legal obligation to do so or the transfer serves criminal prosecution.

The registration of the data subject with the voluntary provision of personal data enables the controller to offer the data subject content or services that, due to the nature of the matter, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller’s database.

The controller shall provide any data subject, at any time upon request, with information as to what personal data is stored about the data subject. Furthermore, the controller shall rectify or erase personal data at the request or notice of the data subject, insofar as this does not conflict with statutory retention obligations. The entirety of the controller’s employees are available to the data subject as contact persons in this context.

Section 9 Contact option via the website

The website of Michael Kraus Industrial Sales Representation contains information required by law that enables quick electronic contact with our company and direct communication with us, which also includes a general address of so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the controller is stored for the purpose of processing or contacting the data subject. This personal data is not passed on to third parties.

Section 10 Existence of automated decision-making

We do not use automated decision-making or profiling.
